Terms of Service
By · Last updated
Tiny Desk AI runs an Outstanding Tiny Desk video generator: you add photos of people or pets, and they take the seats of the band in a short clip (together, the "service"). These terms are the agreement between you and Tiny Desk AI ("we") for using it. Signing up or making a video means you accept them; if you do not, please leave the service unused. The privacy policy covers how personal data is handled.
Eligibility
You need to be 18 or older and legally able to make a contract. The service may not be used from anywhere that sanctions, export controls or other laws rule it out.
Accounts
Accounts are opened with Google or with an email and password. Keep your details accurate and your password private, and let us know straight away if someone else may be using your account; you answer for activity on it. Each account belongs to one person and may not be sold, shared out or handed over.
Photos you upload
Every photo you put into a seat has to meet three conditions:
- It is yours, or you have permission to use it this way.
- Any real person in it is you, or has agreed to appear in the video.
- It contains nothing illegal, hateful, sexual or violent, nothing meant to mislead or pose as someone else, and nothing that infringes another party's copyright, trademark, privacy or publicity rights, for example a character or logo that belongs to someone else.
Photos and finished videos are checked automatically, and anything that fails these conditions is refused; we can also take content down or suspend the account behind it. The acceptable use policy spells out the rules, the consequences and the reporting process in full, and it forms part of these terms.
Things not to do
- Work around content checks, credit charges, unlock rules or usage limits.
- Use bots or scripts on the service, or copy it, resell it or put another brand on it.
- Disrupt the service or other people using it, or test it for security holes without our go-ahead.
Permission to process your photos
Whatever rights you hold in your photos stay with you. To make and deliver your videos, keep the service safe and meet legal duties, you grant us a limited, non-exclusive, royalty-free license to store, copy, transmit and process your photos and videos, including passing them to the providers named in the privacy policy. That license does not cover training AI models, showing your content to other users or using it in our marketing without asking you first.
Who owns the videos
Between you and us, the videos you make are yours, as far as the law allows. Keep them for yourself or post them on social media, including accounts that earn money. Do not pass them off as genuine footage of real events or people, and use a platform's AI-generated label where it asks for one.
Three things to keep in mind: some countries do not grant copyright to AI-generated material; other people can make similar clips of the same performance; and AI output is not perfect, so a face may not match your photo exactly. Save any video you want to keep, because videos can be deleted when your account is closed or if the service ends.
Credits and unlocks
- A video is paid for in credits, and the price depends on quality and length (480p 10 s: 110, 480p 15 s: 165, 720p 10 s: 220, 720p 15 s: 330). You see the cost before anything is generated.
- Credits work only on this service. They are not money and have no cash value; they cannot be sold, transferred or cashed out unless the law says otherwise.
- Pack credits never expire while your account stays open.
- Higher settings open up with your purchases: 10-second 720p becomes available with the Creator pack or a bigger one, and 15-second 720p after two Creator packs or one Studio pack. Unlocks are permanent, and refunded purchases are not counted.
- Credits spent on a video that fails to generate come back to your balance on their own.
- Nothing tops up automatically; credits arrive only when you buy them.
Paying
- When you pay by card, you buy from Anyway, our merchant of record: Anyway takes the payment, is named as the seller on the receipt, and Anyway's buyer terms govern it.
- USDC, a stablecoin tied to the US dollar, is accepted on the Base network through Anyway's crypto checkout. In that case we are the seller and the USDC lands in our wallet, at the same number as the USD price. A blockchain transfer cannot be undone, so send exactly the amount, on the network, shown at checkout; network fees come from your wallet, not from us. Credits appear once the transfer is confirmed.
- A credit pack is a single payment at the price on the pricing page. It never renews and is never charged again.
- Prices for future purchases may change. Credits already in your balance are unaffected.
Refunds
You can get a credit pack refunded within 7 days of buying it, provided no credits have been spent on your account since that purchase. Duplicate or unauthorized charges are refunded in every case once we have confirmed them. Card refunds are returned through Anyway to the card or account you paid with; USDC refunds are sent back in USDC to the wallet that paid. The refund policy, which is part of these terms, gives the full list of what qualifies, how to ask and how long it takes.
Takedown requests
If a video made here infringes your rights or breaks these terms, contact us at support@tiny-desk-ai.pro, describe the content and tell us why it should come down. We look at every request and can remove content or suspend accounts as the acceptable use policy describes.
AI providers and other brands
Videos are generated, and content is checked, by third-party AI models we reach through Alibaba Cloud Model Studio. The companies behind those models have no affiliation with us and do not endorse the service.
The site, its design and its software belong to us or our licensors. The service makes fan videos based on a public internet trend, and it has no affiliation with, endorsement from or connection to NPR, Tiny Desk, Charlie Wilson, The Gap Band, the makers of the viral parody, or anyone who appears in the original performance.
Availability and changes
A third-party AI model makes the videos, so there may be times when the service is slow or down. Formats, options and features may be added, changed or removed, and your credits keep working with whatever your account can use. If we ever plan to close the service, we will say so on the site early enough for you to spend your credits and download your videos.
Closing an account
You can leave at any time by deleting your account on the account page, or, if you cannot sign in, contact us at support@tiny-desk-ai.pro. Deletion removes your photos, your videos and any credits left. We may suspend or close an account that breaks these terms or puts the service or its users at risk, and unused credits on such an account are lost unless the law requires a refund.
Disclaimers
We provide the service "as is" and "as available". As far as the law permits, we make no promise that it will run without interruption or errors, or that it suits any particular purpose.
Liability cap
As far as the law permits, we are not responsible for indirect or consequential loss, such as lost profit or lost data, and our total liability to you is capped at what you paid us in the 12 months before the claim. Liability that the law does not allow to be limited is not limited by these terms.
Your responsibility for claims
If a third party brings a claim against us because of content you uploaded, or because you used your videos in breach of these terms, you agree to cover our reasonable costs of dealing with it, as far as the law permits.
Updates to these terms
These terms may be revised; the date at the top always shows the current version. Signed-in users are told on the site before a change that affects them in a meaningful way takes effect, and using the service after that means accepting the revised terms.
